Welcome to UNGDLY ART ("UNGDLY", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the UNGDLY website, smart contracts, and any related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and all of the terms incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Services.

1. The UNGDLY Project & NFTs

UNGDLY is a digital art collection and generative Web3 ecosystem running on a decentralized blockchain network. The collection consists of unique, non-fungible tokens ("NFTs") that point to digital artwork ("Art"). When you mint or purchase a UNGDLY NFT, you are acquiring ownership of a cryptographic token on the blockchain. We do not have the ability to seize, freeze, or otherwise modify the ownership of any UNGDLY NFT once it has been minted or transferred.

2. Ownership and Intellectual Property

a. Ownership of the Token: Because the UNGDLY smart contract runs on a decentralized ledger, you own the token entirely. You have the right to transfer, sell, or hold your UNGDLY NFT indefinitely.

b. Personal License: Subject to your continued compliance with these Terms, UNGDLY grants you a worldwide, royalty-free license to use, copy, and display the purchased Art, solely for your own personal, non-commercial use, or as part of a marketplace that permits the purchase and sale of your UNGDLY NFT.

c. Commercial Restrictions: You are strictly prohibited from using the UNGDLY Art in connection with products or services that are not affiliated with UNGDLY, in any manner that is likely to cause confusion among consumers, or to commercialize merchandise, brand logos, or derivative works without explicit written permission from UNGDLY ART.

3. User Obligations and Risks

a. Wallet Security: You are entirely responsible for the safety and management of your own private Web3 wallets and validating all transactions and contracts generated by this website before approval.

b. Assumption of Risk: You accept the inherent security risks of providing information and dealing online over the internet. You acknowledge that UNGDLY ART will not be responsible for any communication failures, disruptions, errors, distortions, or delays you may experience when utilizing the blockchain network.

c. Regulatory Volatility: The regulatory regime governing blockchain technologies, cryptocurrencies, and tokens is uncertain. You acknowledge that new regulations or policies may materially adversely affect the development of the UNGDLY ecosystem.

4. Disclaimers & Limitation of Liability

THE UNGDLY SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, UNGDLY ART DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR OTHER VIOLATION OF RIGHTS.

Under no circumstances shall UNGDLY ART, its affiliates, or its partners be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your access or use of or inability to access or use the services and any third-party content and services.
